The present conditions of sale are concluded between :
On the one side « Fred's Guitar Parts » company, SIREN 404486177.
On the other side any individual person or company running a commercial activity hoping to buy a product on the site shop.fredguitar.com.
Hereafter known as the client.
Article 1: Introduction
The present conditions can be seen to define the contractual relationship between FGP's and the client.
Having ordered an item it is understood that the general conditions for sale are accepted.
FGP's themselves reserve the right to modify the conditions of sale at any time. In this case, the conditions are applicable from the date of the order by the client.
Article 2: Prices
Our prices themselves are without taxes, VAT or transportation costs.
FGP's reserve the right to change their prices at any time and without inform the client, the invoice cost will be at the price on the day of delivery. The products sold in the category B-stock benefit from a reduction in price after the following criterias : damage packing, damage goods, certified breakages.
Article 3: Availability
In stock products are available as soon as they are on the site shop.fredguitar.com while stocks last. In case they are not available FGP's will undertake to ask the suppliers if the product is available. If the product is no longer available FGP's will keep it on reserve during a period of 6 months. Over passed this period the order will be cancelled.
Article 4: Orders
Orders can be made on the internet site, by phone or by e-mail.
The client who wish to buy a product is required to :
- create his professional account,
- first of all fill in a Kbis extract within 6 months,
- provide a RIB, a european VAT number and SIRET number.
Article 5: Methods of payment
The client choses his method of payment on opening his account. The methods of payment are :
- Banker's draft,
- Cheque in Euros to the order of FGP's.
Merchandises provided will stay property of FGP's until all the payment is made. In case of non-payment for an item FGP's has the right to take back the product belonging to it. In case of litigation only the TOULOUSE tribunal will be used.
Article 6: Delivery
Transport costs are paid by the client depending on the weight of the package. Different modes of delivery are possible as :
DPD, La Poste and UPS.
The client has to inform us of exact and useful informations for the proper delivery. Also a telephone number must be provided and a mail address to assist the delivery company. Our products safe delivery are in the hands of the client. Any package has to be opened in the presence of the delivery representative. In case of a problem the client must make known on the delivery document any problem and write a recomanded mail to the delivery company within 48 hours. In this mail, the client must indicate clearly damages or losses to expect any return of payment or replacement part. The non application of these clauses apply to the only responsability of the client and forbids any recourse. Any claims by the client will not be accepted after 7 days over the arrival of the merchandises.
Article 7: Return of merchandise
The return of the merchandise in its original packaging are acceptable for a period of two months. The client must first call FGP's manager concerning the return of the merchandise.
After 2 months following the date of the sale invoice (except for the guarantee case) 30 % of the purchase price will be apply on the return product then also on its same value. After 6 months the rate will be 50 % and after 1 year any return of the merchandise will be refused.
Article 8: Intellectual property
Informations sent by the client are the exclusive use of FGP's. Client information will not be sent to other parties and will be treated in confidence.
